Fynzee Terms of Service

Welcome to Fynzee, a Software as a Service (SaaS) platform provided by FYNZEE LIMITED, a company registered in England and Wales with company number 16284810 and registered address Office 11872, 182-184 High Street North, East Ham, London, England, E6 2JA ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of Fynzee’s web application and services (the "Service"), which allows you to manually input financial transactions and invoices, upload receipt images, and use AI-powered receipt scanning. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Use of the Service

1.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Service. By using Fynzee, you confirm that you meet these requirements.

1.2 Account Registration

To access the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@fynzee.com if you suspect unauthorised use.

2. Subscriptions and Payments

2.1 Subscription Plans

Fynzee operates on a monthly subscription model. Details of available plans, features, and pricing are provided on our website www.fynzee.com. All fees are quoted in GBP and are exclusive of VAT, where applicable.

2.2 Payment

You agree to pay the subscription fees for your chosen plan using a valid payment method. Payments are processed monthly in advance via our third-party payment processor. You authorise us to charge your payment method automatically until you cancel your subscription.

2.3 Cancellation and Refunds

You may cancel your subscription at any time via your account settings. Upon cancellation, you will retain access until the end of the current billing cycle. No refunds are provided for partial billing periods or unused services, except as required by UK law (e.g., under the Consumer Contracts Regulations 2013, you have a 14-day cooling-off period for new subscriptions).

2.4 Fee Changes

We may modify subscription fees with at least 30 days’ notice via email or in-app notification. Changes will apply at the start of your next billing cycle. If you do not agree to the new fees, you may cancel your subscription before the change takes effect.

3. Data and Privacy

3.1 User Data

You may input financial transactions, invoices, and upload receipt images ("User Data") to the Service. You retain ownership of your User Data. By uploading or inputting User Data, you grant us a non-exclusive, worldwide, royalty-free licence to store, process, and use it to provide and improve the Service, including sharing receipt images with Open AI for AI-powered receipt scanning.

3.2 Data Storage and Processing

User Data, including receipt images, is stored on our secure servers, which comply with UK GDPR and the Data Protection Act 2018. Receipt images are sent to Open AI for scanning, and we ensure Open AI’s processing complies with our data protection obligations. For details, see our Privacy Policy.

3.3 Data Deletion and Recovery

You may request deletion of your User Data via account settings or by contacting support@fynzee.com. We will delete your data within 30 days, except where retention is required by law. Limited data recovery may be available within 14 days of deletion, subject to our Data Deletion and Recovery Policy.

4. Third-Party Services

Fynzee uses Open AI for receipt scanning. You acknowledge that Open AI’s services are subject to its own terms and privacy policies, and we are not responsible for its performance or data handling practices. We ensure that any data shared with Open AI complies with UK GDPR.

5. Intellectual Property

The Service, including its software, design, and content (excluding User Data), is owned by us or our licensors and protected by copyright and other intellectual property laws. You may not copy, modify, or reverse-engineer the Service without our written consent.

6. Termination

6.1 By You

You may terminate your account at any time by cancelling your subscription and requesting account deletion via account settings or support@fynzee.com.

6.2 By Us

We may suspend or terminate your access to the Service if you breach these Terms, fail to pay subscription fees, or if we suspect unlawful activity. We will notify you of any suspension or termination, where possible.

6.3 Effect of Termination

Upon termination, your access to the Service will cease, and we will delete your User Data in accordance with our Data Deletion and Recovery Policy.

7. Liability and Disclaimers

7.1 Service Availability

We strive to provide uninterrupted access to the Service but do not guarantee it will be error-free or available at all times. We are not liable for downtime caused by maintenance, force majeure, or third-party failures.

7.2 Limitation of Liability

To the fullest extent permitted by UK law, our liability for any claim arising from your use of the Service is limited to the amount you paid for the Service in the 12 months prior to the claim. We are not liable for indirect, consequential, or incidental damages, including loss of data or profits.

7.3 Accuracy of AI Scanning

The AI receipt scanning feature is provided “as is.” We do not guarantee its accuracy and are not liable for errors in extracted data. You are responsible for verifying scanned data.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have rights to bring claims in your local jurisdiction under the Consumer Rights Act 2015.

9. Changes to These Terms

We may update these Terms to reflect changes in the Service or legal requirements. We will notify you of material changes at least 30 days in advance via email or in-app notification. Continued use of the Service after changes constitutes acceptance. If you do not agree, you may terminate your account.
